Introduction

These Terms and Conditions govern your use of the Cofira loyalty mobile application (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Parties

  • Coffee Shop / Loyalty Provider: Cofira, Unit 3a, Bridge Court, 51/55 Bulwark Road, Bulwark, Chepstow, NP16 5JW ("Cofira", "the Coffee Shop", "we", "us").
  • App Developer and Data Processor: Made Responsively Ltd ("Made Responsively").
  • User: You, the individual using the App.

Cofira is responsible for the operation of the loyalty scheme. Made Responsively builds and maintains the App and supporting infrastructure on Cofira's behalf.

2. The Loyalty Scheme

  • The App allows users to collect digital loyalty stamps and redeem rewards, such as free drinks, as determined by Cofira.
  • The number of stamps required, the nature of rewards, and the availability of rewards are set by Cofira and may change from time to time.
  • Loyalty stamps and rewards have no cash value, are non-transferable, and may only be redeemed in accordance with these Terms.

Reward Expiry: To ensure fair use of the scheme, rewards must be redeemed within three (3) months of being earned. Unredeemed rewards may expire after this period and cannot be reinstated.

3. Eligibility and Accounts

  • You must be at least 13 years old to use the App.
  • Authentication is handled via Firebase using one or more of the following methods: Google sign-in, Apple sign-in, Phone number sign-in.
  • You are responsible for maintaining access to your account and ensuring your login details remain secure.

4. Data We Collect and Use

The App is designed to collect only what is necessary to operate the loyalty scheme.

Personal Data: We may collect and process: email address (where provided through Google or Apple sign-in), phone number (where provided through phone authentication), a unique loyalty identifier, and loyalty activity data such as stamps collected and rewards redeemed.

Usage and Technical Data: Anonymous or pseudonymous usage data via Google Analytics to understand how the App is used; crash and error reports via Sentry.io; push notification delivery and campaign data via OneSignal.

Loyalty data is stored securely in a UK-based (London region) Google Firestore database.

5. Data Roles and Responsibilities

  • Cofira acts as the Data Controller for loyalty and user data.
  • Made Responsively Ltd acts as a Data Processor, hosting and maintaining the App, database, and related infrastructure on Cofira's instructions.

6. Use of the App in Store

  • Loyalty stamps are issued when a valid scan is performed at the cafĂ© till using the App.
  • Scans are carried out by Cofira staff. Users cannot self-issue stamps.
  • If a scan fails, is duplicated, or is not recorded correctly, Cofira may manually adjust loyalty data at its discretion.

7. Availability and Reliability

  • The App is provided on an "as is" and "as available" basis.
  • From time to time, the App may be unavailable due to maintenance, updates, connectivity issues, or third-party service outages.
  • We do not guarantee that the App will always be error-free or uninterrupted.

8. Limitation of Liability

To the fullest extent permitted by law:

  • Cofira and Made Responsively shall not be liable for any loss of rewards, data, profits, or goodwill resulting from: technical faults or outages; failed scans or delayed updates; loss of access to your account.
  • Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

9. Changes to the Scheme or the App

  • Cofira may modify, suspend, or withdraw the loyalty scheme at any time.
  • Made Responsively may update or change the App to improve performance, security, or functionality.
  • Continued use of the App after changes are made constitutes acceptance of the updated Terms.

10. Account Termination

  • You may stop using the App at any time.
  • Users can delete their account directly within the App. When an account is deleted, associated loyalty data will be removed in accordance with applicable data protection requirements.
  • Cofira may suspend or terminate accounts where misuse, fraud, or abuse of the loyalty scheme is suspected.
  • Upon termination or deletion, any unused stamps or rewards may be forfeited.

11. Intellectual Property

  • The App, including its design, code, and content, is owned by or licensed to Made Responsively Ltd.
  • Cofira branding, trademarks, and loyalty materials remain the property of Cofira.
  • You may not copy, modify, or distribute any part of the App without permission.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
